Exclusions for Newly Implemented U.S. Tariffs on Steel and Aluminum

Effective March 23, 2018, the United States imposed new tariffs that increase duties on certain imported steel articles by 25 percent, and certain imported aluminum articles by 10 percent. Pursuant to Presidential Proclamations 9704 and 9705, and a supplemental Presidential Proclamation dated March 22, 2018, the following countries will be exempt from the tariffs until April 30, 2018:

  • Canada         
  • Mexico
  • Australia
  • Argentina
  • South Korea
  • Brazil
  • Member countries of the European Union (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom)

The temporary exclusions are based on the country of origin, not the country of export. As of May 1, 2018, covered steel and aluminum imports from all countries will be subject to the tariffs. U.S. Customs and Border Protection (CBP) will issue additional guidance on entry requirements for any products excluded from these measures and updates if there are any changes to these measures.

On March 19, 2018, the U.S. Department of Commerce Bureau of Industry and Security (BIS) published guidance that details how parties in the U.S. may submit requests for exclusions from the additional tariffs electronically. Submissions can be made using docket number BIS-2018-0006 for steel and docket number BIS-2018-0002 for aluminum.
