Formal Entry Requirements Change for Certain Textiles
In a Memorandum issued on June 10, 2009, U.S. Customs and Border Protection (CBP) announced that it is amending the formal entry requirements established by Textile Book Transmittal (TBT)-01-036 for certain textiles.
Per the CBP Memorandum, as a result of the elimination of quotas on merchandise from China entered into the U.S. after December 31, 2008, there is no longer a requirement to file a formal entry as established by TBT-01-036 – except as specified in the Memorandum. Therefore TBT-01-036 is being superseded by TBT-09-007 (Amendment to Formal Entry Requirements for Textiles).
Textiles previously subject to formal entry are now subject to treatment as informal entries or Section 321 releases, whichever is appropriate to the value of the article.
The Memorandum specifies that, per 19 CFR 143.21(a), formal entry continues to be a requirement for shipments of articles valued in excess of US$250.00 and classified as tariff numbers in Sections VII, VIII, XI and XII. The following HTS numbers fall within these sections:
