On August 7, 2019, the Office of the United States Trade Representative (USTR) announced in the Federal Register the first round of selected product exclusions, as enumerated in the annex of the notice, on certain tariffs levied on products from China under Section 301 of the Trade Act of 1974, Tranche 3. See USTR Notice of Tranche 3 Product Exclusions. Importers will no longer have to pay an additional 25% duty on these specified products.
The U.S. International Trade Commission (USITC) added tariff subheading 9903.88.13 to the Harmonized Tariff Schedule of the U.S. (HTSUS) for importers to apply these new exclusions. The exclusions are retroactive back to the September 24, 2018, effective date for Section 301, Tranche 3.
